Terms of Service
These terms apply to Keplerworks tools — including the Carbon tool for embodied carbon analysis from IFC uploads, with Defect and Resilience tools planned — and related exports.

1. Scope
Keplerworks is a business-to-business software platform for architecture, engineering, and construction teams. By creating an account or using Keplerworks, you agree to these Terms on behalf of yourself and, where applicable, your company.
The Carbon tool helps you estimate embodied carbon from uploaded IFC models, optioneer early‑stage design impacts, and generate reports — not replace professional judgement on site conditions, procurement, statutory compliance, or project-specific lifecycle assessment. Defect and Resilience tools are in development; their terms will be updated before general availability.
2. Carbon analysis disclaimers
- Indicative only. Outputs are automated estimates for early‑stage workflows and dialogue. They are not official carbon accounts, statutory submissions, building control filings, audited environmental reports, contractual evidence, certified EPDs, or substitutes for regulator- or insurer-mandated analysis — have results checked by suitably qualified consultants before relying on them in formal contexts.
- Methodology alignment. Reporting is broadly aligned with BS EN 15978 thinking for cradle-to-grave framing where we surface A1–A3 (product stage) cradle-to-gate factors in line with ICE v3.0-style presentation. The methodology label shown in‑product reflects the geography and tier mix resolved for each run.
- Independent validation. You agree to have suitably qualified practitioners validate results before reliance in compliance, contractual, bidding, statutory, certification or investment contexts.
- Data sources and freshness. Factors are sourced from databases and programmes referenced in our Privacy Policy, including federated portals and national datasets. These are refreshed on a periodic basis; older cached values may be used transiently within stated cache windows.
- Confidence. Outputs may attach confidence indicators. Where regional or country‑specific verified EPD data is scarce, indicative factors or broader proxies may dominate — always cross-check locally.
3. Geography anchor and fallback chain
Embodied carbon factors vary by geography, grid carbon intensity and local practice. The Carbon tool resolves factors using the country you confirm during analysis. That choice anchors the model — it does not certify real-world procurement or logistics.
Resolution uses a configurable waterfall: the platform tries richer country-level data where available (including anchors to reference territories where configured), optionally live federated lookups, regional averages such as Ökobaudat EU regional composites, IFC EDGE reference grids where applicable and, when upstream tiers omit a canonical material bucket, defaults to embedded ICE v3.0 reference factors. Ordering can differ between countries.
4. IFC uploads and firm-scoped confidentiality
- Use for analysis only. Uploaded IFC models are transmitted to Keplerworks's controlled infrastructure exclusively to locate geometry/metadata, classify materials or elements where possible, derive quantities, assemble carbon estimates, assemble PDF/CSV/JSON artefacts and uphold security/operations.
- No IFC resale. We do not licence, syndicate or market your IFC as a catalogue product to unrelated third parties. Remote calls to embodied carbon datasets request material / EPD class metadata only — not your building model envelope.
- Removal of source IFC after success. After a completed analysis Keplerworks ordinarily deletes the IFC file blob from application storage while preserving structured summaries and artefacts needed for dashboards, history and exports detailed in our Privacy Policy. Failed uploads or interruptions may briefly retain remnants until housekeeping removes them.
- Tenant isolation. We do not knowingly expose firm-scoped IFC-derived records to another customer organisation.
5. Customer content licence and Keplerworks intellectual property
You retain ownership of uploaded IFC models, project inputs you provide in the workflow, locally saved exports you create, and the substantive carbon quantities and BIM-derived classifications in your analysis outputs and reports.
Keplerworks retains no ownership over your IFC files. Beyond your content, we reserve rights in logos, software (including factor routing and benchmarking copy), UX assets, templates, documentation, and aggregated statistics that do not identify projects.
You grant Keplerworks a limited, royalty-free licence to host, transform, analyse and transmit your content only to run, secure and improve the service — not for unrelated third‑party commercial resale. You may not scrape, circumvent rate limits or reverse engineer the service except where mandatory law allows.
6. Accounts and acceptable use
- Keep passwords and API/session secrets confidential and rotate when staff leave.
- Do not attempt unauthorised intrusion, tenant hopping, scraping behind authentication tokens, excessive automated load that materially harms service quality, unlawful mining of personal metadata, knowingly malicious uploads, or infringing someone else's BIM copyright.
- Professionally scrutinise indicative carbon figures before influencing fee bids, tenders, embodied carbon KPIs owed to regulators or embodied carbon pledges disclosed to the public markets.
7. Service availability, pricing and plans
Keplerworks is provided "as available". Planned maintenance or dependent cloud outages can interrupt uploads; we endeavour to restore swiftly but do not promise uninterrupted SLA metrics beyond what is expressly contracted in enterprise orders signed offline.
Usage caps, quotas, retention windows for free workspaces and payable subscription tiers appear on our Pricing page — we may revise published commercial packages with sensible notice to existing billed customers consistent with Stripe subscription mechanics.
8. Suspension and termination
We may suspend accounts for overdue invoices, abusive traffic, breaches of Sections 6 or unlawful processing instructions. Either party may discontinue use freely. After closure, surviving Personal Data disposition follows our Privacy Policy; paid exports may lapse if your billing status blocks API access.
9. Liability
To the widest extent allowable under governing law Keplerworks excludes liability for indirect losses (lost profit, lost tender, reputational diminution, delay damages, punitive multiplier claims, punitive fines where not mandatorily non-excludable, pure economic diminution).
For direct proven losses attributable to negligent breach capped liability is the fees you paid to Keplerworks in the twelve rolling months before the assertion; if you exclusively use free allowances that cap equals GBP zero except uncapped liabilities that cannot legally be capped (death/personal injury from negligence, deliberate fraud).
Nothing here caps liability unreachable under consumer law applicable to genuinely non-commercial individuals — this product is marketed to businesses.
10. Governing law
These Terms (and associated non-consumer disputes touching them) follow the substantive law of England and Wales. Courts of England and Wales have exclusive jurisdiction subject to compulsory consumer venues if you individually prove non-business use inadvertently.
